Ahmedabad, Sep 20 (PTI) An NGO Jan Sangharsh Manch (JSM), providing legal assistance to some of the post-Godhra riot victims, today submitted a memorandum to Gujarat Governor Kamla requesting her to direct the state government to expedite prosecution of the riot related cases. A delegation of JSM members further requested the Governor to take action against all police officers, who had prohibited the riot victims from holding a ‘Sadbhavna Sabha’ on September 18 at Naroda Patiya. Police had detained riot victims and JSM members who wanted to peacefully protest against Gujarat Chief Minister Narendra Modi’s Sadbhavna fast. During discussion with the Governor, it was pointed out by JSM member S H Iyer that they had submitted an application seeking police permission for holding a meeting at Naroda Patiya well in advance, but police did not respond to it. The permission was neither granted nor rejected by written order, he added. “Around 71 riot victims and activists including a lady social worker Mallika Sarabhai were illegally arrested and detained at Shahibaug headquarter for three hours without any authority of law and without following the process of law,” Iyer alleged. It was further pointed out that the High Court of Gujarat had not stayed the appointment of Justice R A Mehta as Lokayukta and therefore, he may be allowed to function at the earliest. JSM also submitted an open letter to Modi stating that there cannot be ‘Sadbhavna’ without justice. Besides, Iyer the delegation included Samshad Pathan and Usman Qureshi.

An Open Letter to Governor of Gujarat
May it, please, Your Excellency,
WHEREAS our Political system is founded on the principle of ‘responsible government ‘ and there is differences between the law of the Constitution and the conventions of the Constitution and it is believed that there is not currently sufficient conservative wisdom and leadership within the State to exhibit the discipline a Constitutional Convention to a single issue of Lokayukta nor resist the irresistible temptation to “fix” other Constitutional questions and issues instead of in the House but resorting to agitation on public street and thus creating the fear and anxiety in the minds of the Constitutional Institutions and machinery of the State and union leader like tactics against the very democratic conventions of the Government connoting that political actors should constrain their behaviour or refrain from certain courses of action against the State and the public at large. It is imperative to impose the President’s Rule in the State as a corrective measure to safe guard the federal structure of the nation and law and order situation in the State.
