Jan Sangharsh Manch (JSM), which has been contesting for the justice of riot victims, has filed an application before the Supreme Court-appointed special investigation team (SIT) demanding a thorough probe into the conspiracy aspect of 2002 riots cases.
JSM’s lawyer Mukul Sinha told mediapersons on Thursday that SIT has not looked into the conspiracy of any of the cases it has been investigating for the past one year. "The charge sheets filed in these cases show that people are booked for criminal conspiracy under Section 120-B of IPC, but the investigating agency has relied only upon statements of witnesses. It has not conducted a thorough investigation so far as conspiracy of riots is concerned," Sinha said. He added that only those persons have been booked who were allegedly found present on spot during rioting.

JSM has requested SIT chief RK Raghavan to probe these cases further under the provisions of Section 173(8) of CrPC and find out people who were the conspirators of these offences.
JSM also provided a detailed analysis of phone call records furnished by IPS officer Rahul Sharma to prove that chief minister’s office, then minister of state for home Gordhan Zadafia were in constant contact with the accused persons of Naroda Patia and Naroda Gam cases. The accused persons were also in touch with cops on phone after the massacres that happened on February 28, 2002, a day after 59 passengers were killed in the Sabarmati Express near Godhra station.
JSM also informed Raghavan about the movements of former joint commissioner of police MK Tandon and DCP (zone-5) PB Gondhia during the riots and also that they were in contact with the accused persons and moved away from the spot of crime and spent time at Revdi Bazar, where no serious incident had taken place.
JSM team requested SIT head to probe the conspiracy aspect, which has been not touched by the investigating agency till date. According to Sinha, Raghavan assured them of proper inquiry. "SIT has assured us, but if they don’t investigate conspiracy in proper manner, we will move court because the Supreme Court has asked SIT to conduct investigation under Section 173(8) even during trial," Sinha said.
