After clean chit, riot panel to hear plea on summons to Modi

The Nanavati-Mehta Commission, formerly the Nanavati-Shah Commission which in its first report on the 2002 Godhra train burning incident had raised eyebrows by clearing BJP leaders of any involvement in the riots that followed, fixed May 20 for hearing an application on issuing summons to Gujarat Chief Minister Narendra Modi and seven Cabinet colleagues for cross-examination before the panel.

The application was filed by Jan Sangharsh Manch (JSM) representative Mukul Sinha after the Supreme Court on April 27 directed the Special Investigation Team to probe if Modi and 62 others named in a complaint had any role in the riots. In her petition to the apex court, Zakia Jafri, wife of former Congress MP Ehsan Jafri who was burnt alive by a mob that killed 39 people in Gulbarg Society in Ahmedabad, had sought registration of cases against Gujarat BJP leaders and officials at the helm of affairs in 2002.

In August and November 2007, the JSM had urged the Nanavati-Shah Commission to summon Modi and his ministers but a decision was kept pending.

The JSM moved another application ten days ago, pointing out that when the Supreme Court had ordered a probe into the alleged role of Modi and other BJP leaders, the commission was within its rights to summon the Chief Minister and others.

    NDA Governement at the centre and election victories in Gujarat by BJP had embolden the Nanavati Commission to develope the ” Pride and Prejudices” syndrome. Pride for Hindutva and prejudice for the minority community. The Hon’ble Gujarat High Court and Supreme Court Verdicts hold mirror towards the Nanavati Commission Report. The ugly face is exposed. The disese has spread in judiciary, bureaucracy and police and few are spared. Why the particular Additional Sessions Judge is the most favourite among the anticipatory/ regular Bail seekers in Riot cases. It is the high time for the Gujarat High Court to hold inquiry and pass necessary but strict strictures and/or withdraw the criminal powers from such delinquent Judges to safeguard the dignity and decorum of Judiciary…The point is particular most favourite Additional Session Judge of Ahmedabad and no other.
