The Nanavati-Mehta Commission, formerly the Nanavati-Shah Commission which in its first report on the 2002 Godhra train burning incident had raised eyebrows by clearing BJP leaders of any involvement in the riots that followed, fixed May 20 for hearing an application on issuing summons to Gujarat Chief Minister Narendra Modi and seven Cabinet colleagues for cross-examination before the panel.
The application was filed by Jan Sangharsh Manch (JSM) representative Mukul Sinha after the Supreme Court on April 27 directed the Special Investigation Team to probe if Modi and 62 others named in a complaint had any role in the riots. In her petition to the apex court, Zakia Jafri, wife of former Congress MP Ehsan Jafri who was burnt alive by a mob that killed 39 people in Gulbarg Society in Ahmedabad, had sought registration of cases against Gujarat BJP leaders and officials at the helm of affairs in 2002.
In August and November 2007, the JSM had urged the Nanavati-Shah Commission to summon Modi and his ministers but a decision was kept pending.
The JSM moved another application ten days ago, pointing out that when the Supreme Court had ordered a probe into the alleged role of Modi and other BJP leaders, the commission was within its rights to summon the Chief Minister and others.
