Inaugural Session.
(Presided by Shri A.P.Ravani, Retd Chief Justice Rajasthan High Court)
After registration of the delegates, the conference began with the screening of the film `Come see America’ by Sashi, highlighting America as the root cause of violence and oppression all over the world and `Dharamveer’, an animation film by Pravin Mishra of Jan Sangharsh Manch showing how religious sentiments are used by organizations like Sanghparivar to create the lumpen soldiers of violence.
Opening Remarks on behalf of Reception Committee
Dr. Mukul Sinha
In his opening remarks, on behalf of the reception committee of the conference, Dr.Mukul Sinha had reminded the gathering, that it was the western world that had introduced the word “terrorism” and manipulated the same to dominate all public discourse. Any group or individual which spoke out against American dominance or oppression were being termed as terrorists and condemned and this tendency had been whole heartedly adopted by the ruling classes of several countries supporting the American hegemony to destroy their political opponents. The primary objective of the national conference was therefore to present to the people the truth behind the so called terrorist events and fake encounters and remove the confusion amongst the social and political activists who were being swayed under the media blitz on this issue.
Special Guest Speakers:
Mahesh Bhatt, Film Director and social activist.
Addressing the inaugural session as a special guest speaker, the noted film producer and social activist Shri Mahesh Bhatt said that it was the capital of America that has really become the centre of terrorism and he considered the President of America directly responsible for terrorism all over the world. He was invited by the President of America to attend a prayer function to celebrate an important day of America but declined to attend the function on this very ground that he could not associate himself with such people. He further said that there can never be peace without corresponding right being given to the Muslims and the Muslims cannot be deprived of equal right. The real peace would come only when all the citizens of the country are treated equally with dignity and given equal rights and equal protection of law and afforded equal opportunity of growth and development.
Shri A P Ravani
Former Chief Justice, Rajasthan High Court
Shri A.P. Ravani, criticized the demand for re-introduction of POTA by Shri L.K. Advani after the recent bomb blast in Hyderabad. Shri A.P. Ravani said that the demand was ridiculous since it was he, Shri L.K. Advani, who was the Deputy Prime Minister and also the Home Minister when the aeroplane of Indian Airlines was hijacked on 24-2-1999. It was during his tenure as the Home Minister when the Parliament was attacked. The law like POTA though existing, could not save the highest institution of the Indian democracy from the attack; yet, Shri Advani was trying to mislead the people by such ridiculous proposition. Justice Ravani further added that it was the Finance Minister of BJP at centre Shri Jashwant Singh who had handed over Azhar Mohammad to the hijackers of India Airline place at Kandhar in Pakistan and it was the very same Azhar Mohammad who was later on was shown as the main accused in the parliament attack case.

The Global “Terrorism” (Chair: Mahesh Bhatt, Adv)
Feroze Mithiborwala: An overview.
Speaking on global terrorism, Shri Feroze Mithiborwala said that we are in “The Age of the Empire”. The new phase of Imperialism is now wherein, monopoly capital has transformed itself into “Globally Integrated Monopoly Capitalism”. It is not only US Imperialism as is misconstrued, but it is a US-Zionist project. The Military-Industrial Complex is controlled by an alliance of Neoconservatives and Zionists. The Zionists are not only Jewish as is popularly assumed, but also consists of Christian Zionists. Therefore it is not a clash of civilizations or a battle between Judaism, Christianity and Islam, but is a joint struggle against Zionism. Infact the Palestine-Israel conflict lies at the epicenter of International politics and the key to global peace lies in a just solution to this issue.
The Global War on Terrorism is only a pretext for waging wars for global hegemony. The centre piece of this bogus war is the attack on the WTC on September 11, 2001 as well as the supposed threat from Al Qaeda and Bin Laden. This has given the Neocon-Ziocon Bush junta, an unfettered license to declare and wage wars upon the peoples and nations of the world. This is a “war without borders” a seemingly endless war that is both “pre-emptive and preventive” and can be waged as per the whims of any US president. We are being pushed into a phase of “controlled chaos” through a “perpetual state of warfare”.
He also categorically stated that Bin Laden is dead way back in December 2001 and today they are using his ghost to scare the people of the world. Also Al Qaeda is not an organization but is a covert American operation. Every act and video tape of the Al Qaeda helps the Imperial agenda and they also come at very opportune times for the Bush junta.
Today terrorism has emerged as the political and social challenge of our times. Infact, terrorism is not being fostered to instigate communal riots as is wrongly perceived but infact it has replaced communal riots as the strategy of the ruling elite to divide the people, weaken their struggles and thereby enforce the neo-liberal agenda.
Every terror attack results in the widening of the religious divide and increases fear and suspicion amongst the communities. It leads to the further demonization of the Indian Muslim community and pushed them further down the scale. After every terror attack, calls for a strategic alliance with America and Israel against “Islamic terror” have become the norm both within the Government and dominant sections of the corporate media. Therefore the terror attacks on the Indian people are linked to the larger International geo-politics.
Suresh Khairnar: The Indian Scenario
Shri Suresh Khairnar of Dharma Nirapeksh Nagrik Manch, Nagpur, said that the incidents of bomb blast at Nagpur, Malegaon, Nanded, Hyderabad etc. are required to be investigated, not by the so-called Inquiry Commissions appointed by the State since such Commissions would never reach to the truth but by a permanent institution created under the law to unearth the truth in such incidents

Concluding the session, the Shri Mahesh Bhatt said that the war against terrorism can never be fought by any government. It has to be fought by the common people of the country. He said that the American government which bombed Hiroshima and Nagasaki in Japan that killed over 1.5 lac innocent non-combatants and thereafter when turned to destroy millions in Vietnam, Afghanistan and Iraq, was the real terrorist in this world.

The NATIONAL Terrorism-I (Chair: Girish Patel)
Dr. Mukul Sinha: Is Godhra a Terrorist Act?
Speaking in the said session, Dr.Mukul Sinha of Jan Sangharsh Manch made a power-point presentation to establish that the burning of S-6 coach near Godhra railway station on 27 th February 2002 was not a pre-planned terrorist attack by the Muslims as had been alleged by the Chief Minister Shri Narendra Modi. He concluded by asserting that the Godhra incidentThe truth, he said, would go to remove the communal hatred that had been injected in the civil society of Gujarat.
The next speaker, Ms Nirjhari Sinha made a power point presentation on her analysis of the mobile phone call records collected for the period between 27th February to 4 th March 2002 that disclosed a deadly plan hatched by the Chief Minister, Home Minister, Health Minister, the VHP leaders and the high police officials of triggering the massive communal violence against minorities immediately after burning of s-6 coach that resulted in the death of thousands of innocent Muslims. She pointed out that the dead bodies of the 58 karsevaks were brought to Ahmedabad in great haste the same night without any proper postmortem being done with the objective of holding a funeral rally in the early morning of 28 th February. From the evidence on record, she showed that it was the funeral rally, which was attended by over 50 thousand mourners that became the primary source of the mob violence that started the arson near Naroda Patiya which soon spread all over the city of Ahmedabad. She concluded by saying that as evidence had established, it was under the directive of the Chief Minister that the dead bodies were brought to Ahmedabad and this was deliberately done to trigger the violence against the minorities.
Zakia Jowher: “Being a Muslim in Gujarat 2007″
Describing in details the miserable conditions in which the minorities were living in Gujarat following the violence against them in 2002, Ms Zakia Jowher of the Bharatiya Muslim Mahila Andolan lamented the tragic position of Muslims in Gujarat even in 2007 who were being systematically denied all their civil and constitutional rights. She however asserted that there were no reasons to feel defeated or dejected and the Muslims must have full faith in the Indian democracy and exercise their constitutional rights to achieve their demand and dignity.
MAYA VALECHA: “DID RIOT VICTIMS GET JUSTICE?”
Dr.Maya Valecha while describing the events that occurred in Baroda asserted that the minorities have been denied justice after being systematically tortured. She said that though the role of Zahir Shaikh in the Best Bakery case may not be of high standards, yet, everyone seem to have forgotten that she herself was a victim of the violence. While she was punished, nobody including the apex court took any steps to punish the people like Madhu srivastav and others who had coerced or lured her to turn hostile. The role of the NGOs in prosecuting only Zahira was equally questionable.
Concluding comments by chairman
Concluding the session, Shri Girish Patel said that the war against terrorism can not be fought by violence or through judiciary. It is a political fight and therefore we must fight a political battle. We must start a movement- a political movement to fight against `terrorism’.
The National Terrorism-II ( Chair:Jimmy Dhabi)
Dr Hamida Nayeem “State of Civil Liberties In Kashmir.”
Speaking on Kashmir issue, Dr. Hamida Nayeem said that it is very much necessary for all to understand the basic issue of Kashmir where 90 per cent population is Muslim. Though UNO has recognized the right of self-determination of the people of Kashmir, they have been denied plebiscite for the past 60 years. The claim of the Indian Government that Kashmir is the integral part of India is a myth. The people of Kashmir do not agree with this claim. There is no instrument of annexation between the people of Kashmir and the Government of India. The people of Kashmir are being ruled by the stooge governments imposed upon them by the Indian government. Civil liberty movements are being crushed by the armed forces.
Senior Advocate of the Supreme Court Shri Colin Gonsalves described at length the misuse of the Armed Forces Special Powers Act by the army in the North Eastern States and the struggle of Sharmila against the draconian law. He said that Sharmila’s struggle for repeal of the Act is still on and she continues to be on fast since last four years. Giving example of a state-terrorism he cited the case of rape and murder of Manorama by the army jawans in Manipur. Describing the facts of the case of Mohammad Hussain Kalota of Godhara, Mr.Gonsalves said as to how an innocent person is portrayed as terrorist only for political purpose. Mr.Kalota was the president of Godhra Nagarpalika and when he heard first about fire in Sabarmati express on 27th February 2002 it was he who informed the DSP of Godhra about the fire and made all arrangements to rush fire fighters from Nagarpalika. Ultimately, Mr.Kalota was booked under POTA and profiled as a hardcore terrorist who set the train on fire. Mr.Gonsalves was however very much optimistic about the release of Mr.Kalota by the supreme court. “We must fight and continue to fight and we will certainly win. Truth always wins” he said.
(Since time was over and rally was about to start, it was decided to continue the session on the next day.)
A massive rally – MARCH FOR DEMOCRACY – was taken out at the end of the
conference from Town Hall which ended at Sardar Baug in the evening.
2ND SEPTEMBER, 2007 VENUE: NAROTTAM ZAVERI HALL, PALDI
The National Terrorism-II (2nd day)(Chair:Jimmy Dhabi)
Gaffar Shakir: – on attack on RSS headquarter at Nagpur.
On 2-6-2006 when the country woke early in the morning and opened newspapers, it was reported that the RSS head quarter at Nagpur was attempted to be attacked by the terrorists and that the police had failed the attempt and arrested three persons. Nobody questioned what could be the reason for the terrorists to attack headquarter of RSS which is nothing but merely an office? Why nobody heard gunshots of the firing alleged to have been exchanged between the police and the so called terrorists? Why the statements of the people living in the neighborhood of RSS head quarter are not recorded by the police? Why did the Chief Minister of Gujarat announce compensation immediately?
The fact is that the so called `encounter’ between the police and the so called `terrorists’ has never taken place near RSS head quarter. Those three persons were killed elsewhere long back and dumped near RSS head quarter and finally dubbed as `terrorists’.
Arvind Ghosh – on Nanded incident.
It is said that all Muslims are not terrorists but all terrorists are Muslims. However, the incident of Nanded has a different story to tell. Two bomb blasts took place in Nanded and the `terrorists’ were caught red handed. They were making bombs in their house and suddenly the bomb exploded. Raj Podwal, in whose house bomb blast took place, was an activist of RSS. The police said it was a cracker blast. However, the facts emerging from investigation reveal that it was indeed a bomb factory in the house. A demand for impartial enquiry has been raised so as to link all the incidents of bomb blast following Nanded incident
Maulana Azari “Malegaon Blast”
Continuing the discussion on National terrorism on the second day, Shri Maulana Azari described at length the incident of Malegaon blast. He said 32 Muslims were killed in the bomb blast that took place in Kabrastan of Malegaon on 8-9-2006. We knew the role of police since police did know that something was likely to happen in Kabrastan. As we knew, the very next day the news was reported in the Times of India putting the entire blame on Muslims. The police and the government put the blame on Muslims. Whenever such incidents take place in any part of the country, the first and foremost reaction is to put blame on Muslims. The government agencies start investigation keeping in mind the Muslims as their targets and direct investigation from the point of view of either Pakistan or Dhaka connection. We do ask them when you are investigating such a serious case, it is desirable that you conduct impartial enquiry. Those who are killed in the bomb blast, their family members are arrested. Meaning thereby, the victims of the bomb blast are the Muslims, the persons facing the probe are the Muslims, the persons arrested are also the Muslims. No impartial enquiry has been conducted in Malegaon incident. We met the Central Home Minister Shri Shivraj Patil and demanded CBI enquiry. However, except promise, nothing has been done. It makes no difference whether the government is of BJP or Congress. Whatever has been done by the BJP government in Gujarat, the same is sought to be repeated in Maharashtra by the congress government. Shri Maulana further said that since 1963 all those killed in riots in Malegaon were all Muslims and most of them were killed in police firing. One Muslim woman was killed by police from a very close range

Jimmy Dhabhi who presided over the session appealed to the people to recognize the actual terrorist. He said that no religion ever teach of hatred and violence but people like Bush, Blair, Modis and Togadiyas are telling people to hate each other and treat each other as enemies. If we are enemies, we would then start fearing each other and if we are afraid of each other we would need arms to defend, That is when they will come and arm use with trisuls and missiles. We keep fighting as they reap the harvest. Giving example of Salwa Judum, he said that today Advasis are killing each other and the rich are enjoing. Hindus are killing Muslims and they are enjoing. Let us therefore fight the terrorists, people like Bushes and Modis; ofcourse not by the violent means but with debates, propaganda and peaceful movements…
ENCOUNTERS OF THE FOUL KIND

Amrish Patel ” From Samirkhan Pathan to Sohrabbudin “a serial encounter
Tracing the history of violence against the minorities from 28th February, 2002, Amrsih Patel, General Secretary of the New Socialist Movement, stated that the politics of Gujarat ever since Modi took over the reigns of power in 2001, was founded on the theme of “Islamic terrorism”. The burning of the S6 coach of the Sabarmati Expree on 27 th Feb. 2002 near Godhra Rly station was projected as an act of Islamic terrorism and the killing of the minoritires was described as a “just” reprisal. The use of POTA to “control the Islamic terrorists” and the killings of the so called terrorists in fake encounters were all aimed at projecting the just fight of Narendra Modi against the Islamic Jehadis! Fortunately with nthe exposure of the Sourabuddin case, the people of Gujarat are now knowing the truth and the disclosures before the Nanavati Commission was also helping the people to know the truth.
S.H.Iyer: Sadik Jamal- a case study
On 13th January 2003, Sadik Jamal Mehtar was killed by the police. It was reported in the local newspapers in a big way that a terrorist associated with Lashkar-E-Toiba, who had come to Ahmedabad with an intention to kill the then Deputy Prime Minister Shri L.K. Advani, the Chief Minister of Gujarat Shri Narendra Modi and the leader of V.H.P. Dr. Pravin Togadiya, was killed by the police in an encounter.
It appears that the entire story of encounter with police was concocted by Shri D.G. Vanzara, and Shri P.P. Pandey. The so-called encounter of Sadik was totally false and in reality Sadik was actually in the custody of Shri Pandey and Shri Vanzara at Bungalow No.15 which is the office of the Crime Branch at Sahibaugh from 3-1-2003 to 13-1-2003. Sadik Jamal was murdered by and under the conspiracy hatched by Shri D.G. Vanzara and Shri P.P. Pandey to make it clear that the Chief Minister was under attack from terrorist elements and the ghastly crime was committed by the policemen to satisfy the political game plan of the ruling party. Similar story was concocted in the fake encounter of Sohrabuddin Sheikh and it is now widely known that it was supari killing by Shri D.G. Vanzara and other police officer.
Sadik was in the custody of Crime Branch at Bungalow No.15, Sahibaugh from 3-1-2003 till the midnight of 12-1-2003 when he was taken to Naroda and shot at while in police custody. The story that the police accosted him near Galaxy Cinema and that Sadik had fired on them etc. are totally false.
No investigation pursuant to FIR registered against Sadik and 6 others on 13-1-2003 has been carried out by the police. The revolver that was allegedly found from Sadik was of 32 bore whereas the cartridges which were found where of 38 bore. The ballistic report of the F.S.L. has concluded that the bullets that were allegedly fired by Sadik could never have been fired from 32 bore revolver that was allegedly discovered from Sadik.
This contradiction clearly indicates that the police case regarding the shoot out by Sadik was absolutely false.
Sabbir Jamal: My brother was murdered
Sabbir Jamal, the brother of the deceased Sadik, informed the gathering the poor conditions under which his family was living. He said that his family was a law abiding family and Sadik was just like any other young boy in a small town like Bhavnagar. He said it was only from a journalist called Tirodkar that he had come to know that his brother was deliberately profiled as a “terrorist” and killed in cold blood on 13 th January, 2003.
Hamida Nayeem: The ‘missing’ in Kashmir
Fake encounters in Kashmir are routine affair. Thousands of people have been killed under the guise of encounters. There is nothing called democracy in Kashmir. Every Kashmiri lives on gun point of Indian army. The Kashmiris are never welcomed in any part of India. They are always looked at with suspicion. It is very difficult for Kashmiri youth to secure admission for higher studies or find employment in big cities like Mumbai, Delhi or Bangalore or to get shelter in hotel or hire a residence in any other state. She however said that violence was not the way out to resolve the Kashmir issue. It is only the united people’s movement which can resolve the Kashmir issue and bring peace in the region. Peace can be achieved only when the people of Kashmir get justice.

Shri Suresh Khairnar, applauded the speakers from Kashmir and Gujarat for bringing out the naked truth before the people at large and said that all over the country, the state sponsored terrorism was becoming the political line of the ruling parties irrespective of whether it was a BJP or Congress ruled state. Comparing the Gujarat encounters with the encounters in Maharashtra and more specifically with the “terrorists” killed near the RSS head quarters in Nagpur, he said that while Modi did not declare any reward for the police in any of the encounter cases in Gujarat including the Akshardham case, he did it with great haste in the RSS headquarter case. Even the RSS, he said did not call for any bandh or public demonstrations. Khairnar wondered why Modi was so interested in the this case specially when the reports were showing that the “Terrorists” were actually killed at some other place and their dead bodies were brought to the spot by the police!
THE POLITICS OF “TERRORISM”

Aditya Nigam
Shri Aditya Nigam from Delhi warned the gathering not t confine their attention only with the conspiracy theories of international “terrorism” since that would obscure and hide the other big players who were practicing the same brand of violent politics in the country. He said some day the truth of the Parliament attack would also come out just like the truth regarding the Nazis were brought out before the world and they were hunted out even after thirty years later. He also reminded the audience not to overlook the fact that objective contradictions did exist between the Hindu and Muslim community and there were strong feelings of hatred and suspicions for each other. He said these conditions gave rise to the chances of the communal forces using these contradictions and create the rift. The people therefore had to change their views and attitude fundamentally to defeat the communal forces.
Feroze Mithiborwala
Quoting from the policy documents and statements of Condoleeza Rice, Donald Rumsfeld, Zbigniew Brzezinski and Ehud Barak, he stated that formenting terror has become an integral part of American and Israeli foreign policy. He also showed the co-relationship between terror and the reshaping of the geo-political and economic map of the world.
In other words, the primary source of global terror is the Military-Industrial Neoconservative and Zionist alliance centered in Washington DC, Tel Aviv and their allies.
He also stated that the impending war on Iran will be dictated by the logic of Zionism and will be the final catalyst for WWIII, which in any case is on as we speak. This attack on Iran will be launched in the aftermath of another 9/11 style attack, which again will be executed by the same forces. This war will have tragic consequences for the entire world.
Sanjay Singhvi
Shri Sanjay Singvi of CPI (ML) said that in the era of globalization, the very nature of the imperialist globalization gave rise to the violence against the people and unless and until the imperialism itself was defeated it was not really possible to eradicate the menace of fake encounters and fake acts of terrorism. Our country was also aligning itself with the forces of globalization and the recent nuclear deal showed that the Manmohan Government was becoming a strategic ally of the Americans. The point therefore, he said was to struggle to defeat the imperialism itself for real peace.
Suresh Khairnar
Shri Suresh Khairnar, convenor of the Dharma Nirpeksh Nagarik Manch, Nagpur, emphasized the necessity of developing a strategy to defeat the communal forces inside the country and for that purpose create a national net work.
Concluding comments by chairman Dr Mukul Sinha
Dr. Mukul Sinha, chairman of the session, however, instead of concluding the session after the presentations by the five speakers, declared the house open for discussion. Before the speakers from the open house were invited to express their views, a resolution creating a committee for carrying forward the message of the conference was adopted under the name of NATIONAL CAMPAIGN AGAINST FASCISM [ NCAF ]. The composition of the committee is given alongwith the other resolution adopted after the open house discussion.
OPEN HOUSE
Over fifteen speakers came forward from the house to express their views or to put certain queries. The general emphasis of the speakers, specially the youth, was for the declaration of practical programs to defeat the forces of violence and communalism. Three young speakers, namely, Moin Khan, Twinkle and Pravin Mishra urged the house to associate the youth in the ncaf and chalk out such programs which attracted the youth of the country. Ms Twinkle posed the question as to how the struggle against fascism would help her mother get a bucket of water which she had to fetch every day around 1.30 pm in the night at Gandhidham in Kutch;Bhuj. Dr. Hamida Nayeem stated that the nationality question should also become a part of the debate while discussions are held in respect of the struggle against terrorism.
Concluding the last session and responding to the views expressed by the five speakers as well as the speakers in the open house, Dr Sinha stated that while it was true that the immediate concern of the struggle was to reach relief and justice to the victims of fake encounters and fake terrorist dramas and to wipe the tears of the sisters from Kashmir, we cannot do so without understanding the issues themselves. Responding to the point made by Ms Twinkle, he stated that while it was absolutely true that our mothers should not be forced to fetch water at 1.30 pm in the night, we must also ask the question why our mothers are being forced to do this and by whom? We have to ask the question as to why we are not directing out struggle and energy to get out material needs but are getting involved in such reactionary activities like communal riots. By remaining passive and silent spectators, we have in fact played into the hands of the politicians who want to project “terrorism” as our main problem. The struggle therefore starts by informing the people about the truth behind such acts and omissions and drawing the people into a sustained campaign against fascism of all types.
RESOLUTIONS
The following resolutions were passed unanimously after the open house discussions:

The conference resolved to carry forward the struggle and campaign against fascism, terrorism and fake encounters all over the country.

It was unanimously resolved to appoint a committee of eight conveners to continue with the campaign against fascism as initiated in the present conference. The Conveners nominated by the house were:
(1) Dr.Mukul Sinha, of New Socialist Movement, Ahmedabad (2)Shri Suresh Khairnar of Dharma Nirepeksh Nagarik Manch, Nagpur (3) Shri Feroze Mithiborwala of Awami Bharat, Mumbai (4) Maulana Azari from Malegaon (5) Ms Zakia Jowhar of Bharatiya Muslim Mahila Andolan, from Ahmedabad (6) Shri Aditya Nigam from Delhi(7) Shri Kishore Jagtap of Awami Bharat from Mumbai and (8) Dr. Hamida Nayeem. of Bharatiya Muslim Mahila Andolan from Kashmir.
It was further resolved that the above committee of ncaf will be responsible to hold the next conference at Mumbai sometime in December, 2007 and will be replaced by another body in the next conference. The primary task of the committee was to organize, campaign and build up a mass resistance against all fascist tendencies.

The meeting condemned the systematic demonization of the Muslims and Islam and the systematic and repeated persecution of Muslims all over the world.

The meeting condemned the US imperialism and its unfettered agenda for Global hegemony as well as the allies of the Empire for the spreading the culture of violence and wars all across the globe and held them to be the real source of terrorism all over the world.

The meeting demanded true and fair investigation by a judicial commission of all the incidents of terrorist attacks and bomb blasts including the incidents of attack on Parliament, Akshar Dham, Malegaon, Nanded, Hyderabad, Nagpur, Sankat Mochan, Mumbai train blast etc.

The meeting demanded immediate implementation of the Shri Krishna Commission’s recommendations.

The meeting resolved to demand amendment of the Constitution so as to create a permanent Commission to enquire into and take appropriate action into the incidents involving deaths of non-combatants and police encounters.

On the basis of the material and evidence available, the meeting demanded immediate arrest of Shri Gordhan Zadafia, the then Home Minister of Gujarat, for his active participation in the genocide of Muslims in Ahmedabad after Godhra train burning incident in 2002.
