Admits petition filed by Sabbir Jamal brother of Sadik Jamal who was killed in fake encounter by Gujarat Police
On 13th january 2003, a young boy from bhavnagar, Sadik Jamal was shot dead in Naroda area of Ahmedabad, India by the Gujarat Police who alleged that Sadik was a terrorist connected with Lashkar-e-Toiba and Dawood Ibrahim gang. It was also alleged that Sadik was sent by terrorist organizations to kill the Chief Minister of Gujarat, Narendra Modi and pravin togadia, the VHP International General Secretary.
Journalist Mr. Ketan tirodkar had however confessed before a Mumbai Special Court that he and the notorious police inspector Daya Nayak of Mumbai Police had profiled Sadik as a terrorist and handed him over to Gujarat police on 11th of January 2003 on the request of some top Gujarat politician. Thus Sadik was in the police custody before he was shot dead in the fake encounter.
The final hearing of the case has been fixed on 7th october 2008 and the high court has ordered all cases papers lying with the Magistrate court to be sealed to secure it from any tampering.
